Qmobile Inc. (“Qmobile”) takes the privacy of our customers and the security of their Personal Information very seriously. We provide this Privacy and Security Statement ("Statement") because you have the right to know what personal information we collect, how it is protected and used and the circumstances under which it may be disclosed.

To Whom this Statement Applies

This Statement only applies to Qmobile, and the websites that Qmobile owns and operates, including http://www.qtones.com, http://www.40100.com, http://www.40200.com, and http://www.40300.com (the “Sites”).  This Statement does not apply to affiliated entities of Qmobile or to third parties.

The Personal Information We Collect

 Qmobile offers a variety of downloadable mobile entertainment products via the Sites, such as ringtones, voice mail, games, text alerts and graphics as well as chat, dating and other interactive mobile entertainment services (collectively, the “Products and Services”).  You acknowledge that Qmobile may collect and process “Personal Information” in connection with the Products and Services.  The Personal Information we collect may include contact information (i.e. information that could be used to contact you, such as full name, postal address, phone number or e-mail address), financial information (i.e. credit card numbers, bank account information or passwords) and demographic and usage information (i.e. information that you submit, or that we collect, that is neither personal information nor financial information but necessary for the proper functioning and billing of our service, such as the date regarding the start and end and the extent of your usage of the service).

Qmobile will not sell your Personal Information to third parties, except in connection with the sale of the Site(s) and/or Products and Services in whole or part. Qmobile may pass on your Personal Information to Qmobile’s affiliates for any purpose.  Qmobile may pass on your Personal Information to your mobile phone service provider to secure collection of fees; such information collected by Qmobile may be stored and processed in any other country in which Qmobile or its agents maintain facilities. By using the Products and Services, you consent to any such transfer to the Qmobile’s affiliates and the transfer of information outside of the United States and Canada.

Your Personal Information will be deleted no later than six months after termination of your subscription. Qmobile may store your information beyond this date if that is required by law or contract.

Uses of Personal Information

When you submit Personal Information or authorize the submission of Personal Information to Qmobile, you will be asked to decide how we may use your information. Unless we specifically tell you otherwise before you submit Personal Information, we will only use it to:
(1)        Better understand your viewing habits, desires and needs;
(2)        Help us understand how we can improve our products, services, and website(s); and
(3)        Contact you to ask for your opinion or willingness to participate in certain activities; or events. 

These options give you the opportunity to control the usage of your Personal Information by "opting out" of our systems.  In the event you have not given permission for certain Personal Information to be posted or published on the Sites, please contact us immediately

We may aggregate this data to analyze the viewing habits of our site visitors, but it will not be associated with any personally identifiable data.

Sharing Your Personal Information With Others

Qmobile will not use or share your Personal Information in ways unrelated to the uses described above unless we provide you with prior notice and give you an opportunity to change your usage preferences.

Unless you give us prior consent or make a specific request, Qmobile will not trade, sell, or share your Personal Information with any person or entity other than appropriate authorized individuals within Qmobile and its subsidiaries, affiliates and representatives, unless required by law or as disclosed to you before the information is collected.

How You Can Control the Use of Your Personal Information

You may review and change contact information such as address, phone and email by signing on and updating your personal profile.

If you have already submitted Personal Information to qtones.com or given permission for Personal Information to be submitted, posted, uploaded, or published, you may opt-out of Qmobile’s future use of that information by sending a specific email request to support@qtones.com. Upon receiving and verifying your request to the best of our ability, we will delete your Personal Information from our records.
 
There are known methods that spammers can use to hide their identity by using other people's email address to send out emails. If you have any question about the genuineness of an email you receive that appears to be from Qmobile or qtones.com, contact us at support@qtones.com and do not furnish Personal Information in response to the email.

WHEN YOU USE INTERACTIVE CHAT SERVICES, PLEASE USE A CHAT NAME THAT DOES NOT DISCLOSE YOUR PERSONAL IDENTITY. NEVER DISCLOSE YOUR PERSONAL INFORMATION (SUCH AS YOUR REAL NAME, PHONE NUMBER, ADDRESS OR OTHER INFORMATION THAT WOULD ENABLE OTHERS TO IDENTIFY OR LOCATE YOU) DURING ANY CHAT SESSION.  

Security of Your Information

The security of your Personal Information is very important to us. We use appropriate technical and managerial procedures to protect your Personal Information and prevent its disclosure outside Qmobile and those service professionals with whom we do business. Only those authorized by Qmobile or you will be granted access to your Personal Information.

Children under 13 years of age are not authorized to use the Site or the Products and Services.  Children under the age of 18 may use the Site and some Products and Services with parental consent, except in no case shall children under the age of 18 utilize Interactive Chat services (as that term is defined in the Terms of Use).  

The Federal Trade Commission has established rules for Web site operators to make sure that children’s privacy is protected while they're online. The Qtones Daily Horoscope Service is $9.99 per month ($6.99 per month for Boost Mobile) charged to your mobile phone bill monthly or deducted monthly from your pre-paid balance. Please note that in addition, Msg&Data Rates May Apply to each daily horoscope we send you. You may cancel ("Opt-Out") of the Qtones Daily Horoscope Service at any time by sending a text (SMS) message with the word "stop" to 40100 as the only text in it. We will confirmed your cancellation and no further messages will be sent. Please note that we will cease sending you horoscopes on the day you request, but you will still be billed the full amount for any partial month.
